New Mexico’s Blood Alcohol Limits
Drivers of recreational vehicles in New Mexico are upheld to the same standards as every other driver throughout the nation when it comes to drinking while driving. A person may not drive with a BAC of .08% or greater without committing a DUI/DWI offense. However, New Mexico has imposed stricter standards for commercial drivers (.04%) and drivers under the legal drinking age (.02%).
The penalties associated with a DUI are harsher for commercial and underage drivers as well. Non-commercial drivers who receive a first-time DWI conviction will have their license suspended for six months. A commercial or underage DWI conviction, however, is punishable by a one-year suspension of driving privileges. Both commercial, non-commercial and underage drivers are subject to fines, court-ordered treatment, alcohol screenings and community service as well.

Alcohol is not the only means by which a person may become impaired. Both illegal and prescription drugs can hinder a person’s ability to safely operate a motor vehicle.
